Apple looks to be sitting in a better position, because the iTMS is already so well established that it's harder for Universal (or any other part of the music industry) to put the squeeze on - they'd more likely lose out by not having their content available at the iTMS.

[Qonverge.com] Qonverge Blog: Microsoft took a winning concept with the Zune, a suped up media player that plays music files and video with the added bonus of WiFi (something Apple’s iPod doesn’t have), and already have markeitng issues on their hands.
